TERMS AND CONDITIONS

These Terms and Conditions explain the rules, expectations, rights, and responsibilities related to all websites, programs, memberships, software, courses, services, and digital products operated by Kito J. Johnson Enterprises, LLC, including its affiliated brands The HEIRS System, The HEIRS Real Estate Family Skool community, GenSuite 360, and The BNS Companies LLC. When you access or use any product or service offered by these entities, you agree to these Terms.
Acceptance of These Terms
By accessing, purchasing, subscribing, or using any website, digital product, software, membership, course, event, or resource provided by the Company, you confirm that you have read, understood, and accept these Terms. If you do not agree, do not use any of the Company’s services.
Services Provided
Kito J. Johnson Enterprises, LLC and its affiliated brands provide real estate education, faith-based real estate training, digital courses, downloadable tools, business and investment training, membership communities, coaching, SaaS products, workshops, webinars, online events, newsletters, and related digital content. These services may be updated, changed, restructured, expanded, or discontinued at any time.
Payments, Billing, and Subscription Rules
- All payments for digital products, courses, toolkits, membership plans, software tools, events, and services are final.
- Digital products are non-refundable.
- Membership subscriptions renew automatically. You may cancel future billing at any time through your account settings. Past charges are not refundable.
- Coaching or consulting sessions may be rescheduled once with at least 48 hours notice. Missed or late-cancelled sessions are forfeited.
- Billing may be processed through Stripe, PayPal, Square, Keap Pay, or other approved processors.
No Guarantees of Results or Income
All information provided through the Company’s brands is educational. Real estate involves risk. Outcomes vary widely. You acknowledge that:
- The Company does not guarantee deals, profits, income, or financial success.
- Testimonials represent personal experiences and do not guarantee the same results.
- Market conditions, personal decisions, credit factors, skills, and external conditions affect outcomes.
- Any references to faith, scripture, or spiritual encouragement are inspirational and not predictors of financial results.
You agree to use independent judgment and seek professional advice when needed.
Professional Disclaimer
The Company does not provide legal, tax, financial, accounting, or investment advice. You agree to consult licensed professionals before making real estate or financial decisions. You accept full responsibility for your actions, decisions, deals, transactions, and results.
Intellectual Property Ownership
All content, systems, frameworks, curriculum, software, videos, audio, downloads, templates, toolkits, worksheets, quizzes, assessments, branding, designs, writing, and materials created by the Company remain the exclusive property of Kito J. Johnson Enterprises, LLC and its affiliated brands. This includes proprietary systems such as PR5, real estate avatars, educational models, SaaS features within GenSuite 360, and any learning materials inside the HEIRS community.
You may not copy, distribute, modify, reproduce, share, resell, upload, post, transmit, or create derivative works from any Company content. Unauthorized use may result in account termination and legal action.
Login Sharing and Unauthorized Access
- Accounts, logins, passwords, and software access are for one paying user only.
- You may not share, transfer, sell, or distribute your access.
- You may not record screen sessions, copy content, or download materials unless expressly permitted.
- Creating competing programs or using Company content for training others is strictly prohibited.
The Company may suspend or terminate accounts if login sharing or unauthorized distribution is detected.
Community Conduct
The HEIRS Real Estate Family Skool community and all Company platforms require respectful behavior. The following actions are not permitted:
- Harassment, bullying, or disrespectful conduct
- Posting harmful, illegal, misleading, or inappropriate content
- Spamming or unsolicited promotion
- Soliciting members for personal business
- Disruptive behavior or actions that undermine the community
- Recording, copying, or sharing community content outside the platform
The Company may remove any user who violates these expectations without refund.
Termination and Suspension of Access
The Company may suspend or terminate access to memberships, software, programs, communities, or digital products for:
- Violations of these Terms
- Abusive behavior toward staff or members
- Chargebacks or fraudulent payments
- Unauthorized distribution or login sharing
- Misuse of content or intellectual property
- Disruptive or harmful behavior
- Non-payment of subscription fees
Termination does not obligate the Company to provide refunds or reinstatement.
Ownership and Assignment
You may not transfer or assign your rights or access. The Company may assign or transfer its rights, ownership, assets, brands, or obligations at any time as part of business growth, restructuring, or sale.
Acceptable Use of GenSuite 360 and Company Software
You agree not to:
- Reverse engineer
- Copy or duplicate features
- White-label or clone the system
- Scrape, extract, or misuse data
- Share access with non-authorized individuals
- Use the platform to overload systems or manipulate performance
- Attempt to breach security or bypass protections
Any violation may result in immediate termination and potential legal action.
Digital Product Delivery and Access Duration
- All digital products, downloads, and courses are provided on a license-to-use basis. You do not own the content.
- Access to courses, communities, software, and content may change at any time.
- Membership access remains active only during paid periods.
- The Company may modify, limit, or remove access to content, features, or programs as needed.
- Access does not guarantee future updates or lifetime availability.
Third-Party Platforms
The Company uses third-party tools including Stripe, PayPal, Square, Keap Pay, Skool, GenSuite 360, Google Calendar, Canva, Google Drive, YouTube, Zoom, Meta Pixel, and Google Analytics. Each platform has its own privacy and security practices. The Company is not responsible for actions or failures of any third-party service.
Technical Issues and Service Availability
Digital services may experience downtime, updates, maintenance, or interruptions. The Company is not responsible for issues caused by user devices, internet providers, or third-party platforms. No refunds will be issued for outages, delays, errors, or interruptions of any kind.
User Responsibility and Compliance
- You agree to follow all federal, state, and local real estate laws, MLS rules, licensing requirements, fair housing regulations, and any applicable professional rules.
- You agree to secure your login credentials, protect your devices, and back up your data.
- You agree not to rely solely on the Company’s information for investment decisions.
Privacy and Data
The Company collects information necessary to operate its services. By using the Company’s platforms, you consent to data collection, cookies, analytics, email communications, and integrated platform functionality. A separate Privacy Policy governs how your information is stored, used, and shared.
Limitation of Liability
To the fullest extent permitted by law, the Company is not responsible for:
- Investment losses
- Business losses
- Real estate transaction outcomes
- Technical failures
- Income expectations
- Decisions you make based on the Company’s training
- Misuse of content or community interactions
- Third-party software issues
Total liability, if ever applicable, is limited to the amount paid for the specific product or service.
Kito J. Johnson Enterprises, LLC, its owners, officers, directors, managers, members, employees, contractors, agents, partners, affiliated entities, representatives, and Kito J. Johnson individually are protected under this agreement.
Indemnification
You agree to protect and compensate the Company if your use of the services leads to claims, damages, or disputes. This includes legal fees, liabilities, or issues arising from:
- Misuse of Company content
- Business or real estate decisions
- Conduct inside the community
- Software misuse
- Violations of laws or regulations
- Violations of these Terms
This protection includes all affiliated brands and Kito J. Johnson personally.
Disputes and Arbitration
All disputes will be resolved through binding arbitration in the State of Georgia. Class actions are not permitted. Each dispute must be handled individually. The Company may pursue legal action for intellectual property violations or unauthorized distribution.
Governing Law
These Terms are governed by the laws of the State of Georgia.
Entire Agreement
These Terms represent the full agreement between you and the Company. Updated versions replace previous editions. Failure to enforce any provision does not waive enforcement rights.
Headings and Interpretation
Headings are for convenience only. Ambiguities will not be interpreted against the Company as the drafter. Singular and plural forms carry the same meaning unless otherwise stated.
